But that's my point, it's so similar and they even admit to making it to piggyback the success of the film they're mimicking, so why haven't they been shut down?

Probably because The Asylum don't really make big enough bucks to make it worth suing them. All their movies are straight-to-dvd and you don't see any TV commercial or anything. Most of the people behind the "real" movies probably don't even know about "mockbusters".

From what I have read, they often just break even against production costs with their movies.

Not true, their last few movies have had commercials and get special playing times on my favorite channel: SyFy.

Flipping through the channels, I landed on SyFy for a brief time. Journey to the Center of the Earth, but not the cool one - it was the one with the hot lesbians fighting each other in the beginning. Got boring shortly after and changed the channel to something more interesting, like Mythbusters.
